REGULATIONS OF TRANS.EU SYSTEM\u2019S API<\/h2>\n

I. Gen\u00ader\u00adal Pro\u00advi\u00adsions<\/p>\n\n\n\n

  1. These Reg\u00adu\u00adla\u00adtions (here\u00adinafter: \u201cReg\u00adu\u00adla\u00adtions\u201d) deter\u00admine the prin\u00adci\u00adples of use of API ser\u00advices of the Trans.eu Sys\u00adtem, pro\u00advid\u00aded by Trans.eu Group S.A. , seat\u00aded in Wroc\u0142aw, to the own\u00aders and admin\u00adis\u00adtra\u00adtors of soft\u00adware and web\u00adsites.<\/li>\n
  2. The pur\u00adpose of API is to enable log\u00adging access to the Trans.eu Sys\u00adtem, and hence reduce the amount of man\u00adu\u00adal work and increase work effi\u00adcien\u00adcy by, in par\u00adtic\u00adu\u00adlar, auto\u00admat\u00adic plac\u00ading of offers on the Exchange, search\u00ading for avail\u00adable cars, as well as mon\u00adi\u00adtor\u00ading of orders.
    II. Def\u00adi\u00adn\u00adi\u00adtions
    The terms used in the Reg\u00adu\u00adla\u00adtions shall mean:<\/li>\n
  3. API of the Trans.eu Sys\u00adtem \u2013 ser\u00advice pro\u00advid\u00aded by Trans.eu Group S.A. for Part\u00adners, enabling use of resources of the Trans.eu Sys\u00adtem.<\/li>\n
  4. Error \u2013 incon\u00adsis\u00adten\u00adcy between the descrip\u00adtion in the Trans.eu Sys\u00adtem\u2019s API Doc\u00adu\u00admen\u00adta\u00adtion and the actu\u00adal oper\u00ada\u00adtion of the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  5. The Trans.eu Sys\u00adtem\u2019s API Doc\u00adu\u00admen\u00adta\u00adtion \u2013 col\u00adlec\u00adtive descrip\u00adtion of all avail\u00adable resources, meth\u00adods and func\u00adtions of the Trans.eu Sys\u00adtem\u2019s API, which is made avail\u00adable to the Part\u00adner. Trans.eu Group S.A., seat\u00aded in Wroc\u0142aw (53\u2013146 Wroc\u0142aw) at Rac\u0142aw\u00adic\u00adka 2\u20134, entered in the Reg\u00adis\u00adter of Entre\u00adpre\u00adneurs kept by the Dis\u00adtrict Court for Wroc\u0142aw \u2013 Fab\u00adrycz\u00adna in Wroc\u0142aw, 6th Com\u00admer\u00adcial Depart\u00adment, under KRS num\u00adber: 0000162430, Tax Iden\u00adti\u00adfi\u00adca\u00adtion Num\u00adber (NIP): 8942764658, Nation\u00adal Busi\u00adness Reg\u00adistry Num\u00adber (REGON): 932920615.<\/li>\n
  6. Soft\u00adware \u2013 soft\u00adware owned or admin\u00adis\u00adtered by the Part\u00adner, which uses the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  7. Part\u00adner \u2013 a nat\u00adur\u00adal per\u00adson, legal per\u00adson or organ\u00adi\u00adsa\u00adtion\u00adal unit with\u00adout legal per\u00adson\u00adal\u00adi\u00adty that is grant\u00aded legal capac\u00adi\u00adty by the Act, who is the own\u00ader or admin\u00adis\u00adtra\u00adtor of the soft\u00adware or web\u00adsite used first of all by rep\u00adre\u00adsen\u00adta\u00adtives of the TFL indus\u00adtry, who obtained access to the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  8. Trans.eu Reg\u00adu\u00adla\u00adtions \u2013 the Reg\u00adu\u00adla\u00adtions for pro\u00advi\u00adsion of ser\u00advices and secu\u00adri\u00adty of the Trans.eu Sys\u00adtem, avail\u00adable at http:\/\/www.trans.eu\/pl\/regulamin<\/li>\n
  9. Web\u00adsite \u2013 a web\u00adsite owned or admin\u00adis\u00adtered by the Part\u00adner, who con\u00adnects to the API of the Trans.eu Sys\u00adtem.<\/li>\n
  10. The Trans.eu Sys\u00adtem \u2013 a plat\u00adform ded\u00adi\u00adcat\u00aded, among oth\u00aders, to the TFL indus\u00adtry, used, among oth\u00aders, for exchang\u00ading infor\u00adma\u00adtion about vacant vehi\u00adcles and loads, for acquir\u00ading con\u00adtrac\u00adtors, for com\u00admu\u00adni\u00adca\u00adtion between sys\u00adtem users through the busi\u00adness mes\u00adsen\u00adger, the so-called TransCom\u00admu\u00adni\u00adcate, the ser\u00advice provider and licen\u00adsor of which is Trans.eu Group S.A. .<\/li>\n
  11. User \u2013 an enti\u00adty being the user of both the Trans.eu Sys\u00adtem, as well as the Web\u00adsite or Soft\u00adware owned or man\u00adaged by the Part\u00adner.<\/li>\n
  12. Appli\u00adcant \u2013 a nat\u00adur\u00adal per\u00adson, legal per\u00adson or organ\u00adi\u00adsa\u00adtion\u00adal unit with\u00adout legal per\u00adson\u00adal\u00adi\u00adty that is grant\u00aded legal capac\u00adi\u00adty by the Act, who sub\u00admit\u00adted the appli\u00adca\u00adtion to Trans.eu Group S.A. for mak\u00ading avail\u00adable the Trans.eu Sys\u00adtem\u2019s API, via an elec\u00adtron\u00adic form avail\u00adable on the web\u00adsite http:\/\/www.trans.eu\/pl\/ or in any oth\u00ader form.<\/li>\n
  13. Tech\u00adni\u00adcal Sup\u00adport \u2013 tech\u00adni\u00adcal assis\u00adtance pro\u00advid\u00aded by Trans.eu Group S.A. to the Part\u00adner, which cov\u00aders repair of Errors report\u00aded by the Part\u00adner.
    III. The prin\u00adci\u00adples of mak\u00ading avail\u00adable the API of the Trans.eu Sys\u00adtem<\/li>\n
  14. The Appli\u00adcant may request access to the Trans.eu Sys\u00adtem\u2019s API, by fill\u00ading a respec\u00adtive elec\u00adtron\u00adic form avail\u00adable on the web\u00adsite: http:\/\/www.trans.eu\/pl\/, or in any oth\u00ader way, this way express\u00ading his inten\u00adtion to use the Trans.eu Sys\u00adtem\u2019s API. After cor\u00adrect\u00adly fill\u00ading in the form or inform\u00ading Trans.eu Group S.A. about the will\u00ading\u00adness to use the Trans.eu Sys\u00adtem\u2019s API, Trans.eu Group S.A. shall con\u00adtact the Appli\u00adcant with\u00adin 5 days from the date of receipt of the mes\u00adsage to ver\u00adi\u00adfy the Appli\u00adcant, i.e. to eval\u00adu\u00adate whether he guar\u00adan\u00adtees due and reli\u00adable con\u00adduct, con\u00adsis\u00adtent with these Reg\u00adu\u00adla\u00adtions, and also to eval\u00adu\u00adate the Web\u00adsite or Soft\u00adware that will utilise the Trans.eu Sys\u00adtem\u2019s API. The ver\u00adi\u00adfi\u00adca\u00adtion, referred to in the pre\u00advi\u00adous sen\u00adtence, applies also to ver\u00adi\u00adfy\u00ading whether the Web\u00adsite or Soft\u00adware meet the tech\u00adni\u00adcal require\u00adments nec\u00ades\u00adsary for due use of the Trans.eu Sys\u00adtem\u2019s API. Trans.eu Group S.A. reserves the right to refuse to grant access to the Trans.eu Sys\u00adtem\u2019s API with\u00adout giv\u00ading any rea\u00adsons and shall not bear any lia\u00adbil\u00adi\u00adty on this account.<\/li>\n
  15. After suc\u00adcess\u00adful ver\u00adi\u00adfi\u00adca\u00adtion by Trans.eu Group S.A. , referred to in item III.1., the Appli\u00adcant is oblig\u00aded to accept the updat\u00aded ver\u00adsion of these Reg\u00adu\u00adla\u00adtions in order to gain access to the Trans.eu Sys\u00adtem\u2019s API. Then, with\u00adin 7 busi\u00adness days from the date of accep\u00adtance of the updat\u00aded ver\u00adsion of these Reg\u00adu\u00adla\u00adtions by the Appli\u00adcant, Trans.eu Group S.A. shall make avail\u00adable in the Appli\u00adcan\u00adt\u2019s pro\u00adduc\u00adtion envi\u00adron\u00adment the acti\u00adva\u00adtion key enabling use of the API of the Trans.eu Sys\u00adtem. From that moment, the Appli\u00adcant becomes the Part\u00adner.<\/li>\n
  16. After obtain\u00ading access to the Trans.eu Sys\u00adtem\u2019s API, the Part\u00adner shall be oblig\u00aded to enable the Users con\u00adnec\u00adtion to the Trans.eu Sys\u00adtem\u2019s API, by hav\u00ading a Trans.eu Sys\u00adtem login win\u00addow avail\u00adable on the Website\/in the Soft\u00adware, in accor\u00addance with these Reg\u00adu\u00adla\u00adtions.<\/li>\n
  17. Trans.eu Group S.A. shall make the Trans.eu Sys\u00adtem\u2019s API avail\u00adable on the basis of non-exclu\u00adsive, free licence, the con\u00addi\u00adtions of which are deter\u00admined by item V of these Reg\u00adu\u00adla\u00adtions.<\/li>\n
  18. Trans.eu Group S.A. , in coop\u00ader\u00ada\u00adtion with a per\u00adson indi\u00adcat\u00aded by the Part\u00adner, shall enable inte\u00adgra\u00adtion of the Website\/Software with the Trans.eu Sys\u00adtem by mak\u00ading the API avail\u00adable.<\/li>\n
  19. The inte\u00adgra\u00adtion is designed to exchange the User\u2019s data and process them through the Trans.eu Sys\u00adtem\u2019s API, in order to allow the User to use the API func\u00adtion of the Trans.eu Sys\u00adtem through the Website\/Software.<\/li>\n
  20. Trans.eu Group S.A. is respon\u00adsi\u00adble for oper\u00ada\u00adtion of the pro\u00adduc\u00adtion envi\u00adron\u00adment and for grant\u00adi\u00adng rel\u00ade\u00advant autho\u00adri\u00adsa\u00adtion to the Part\u00adner. The Part\u00adner is respon\u00adsi\u00adble for prepa\u00adra\u00adtion (adjust\u00adment) of the Website\/Software. The Par\u00adties intend to com\u00adplete the afore\u00admen\u00adtioned works with\u00adin 60 days from the date when of mak\u00ading the Trans.eu Sys\u00adtem\u2019s API avail\u00adable.<\/li>\n
  21. Trans.eu Group S.A. pro\u00advides the Part\u00adner with Tech\u00adni\u00adcal Sup\u00adport with\u00adin the peri\u00adod of mak\u00ading avail\u00adable the Trans.eu Sys\u00adtem\u2019s API. The Part\u00adner reports an Error via an e\u2011mail mes\u00adsage sent to api@trans.eu. Trans.eu Group S.A. is oblig\u00aded to com\u00admence pro\u00advi\u00adsion of Tech\u00adni\u00adcal Sup\u00adport with\u00adin 3 busi\u00adness days from the date of receipt of the mes\u00adsage, referred to in the pre\u00advi\u00adous sen\u00adtence.<\/li>\n
  22. The Part\u00adner, who has no access to the Trans.eu Sys\u00adtem\u2019s, shall obtain access for the inte\u00adgra\u00adtion peri\u00adod on gen\u00ader\u00adal account terms for a tri\u00adal peri\u00adod. The Part\u00adner shall bear full respon\u00adsi\u00adbil\u00adi\u00adty for cor\u00adrect use of the Trans.eu Sys\u00adtem, con\u00adsis\u00adtent with the Reg\u00adu\u00adla\u00adtions of Trans.eu, as well as for any pos\u00adsi\u00adble dam\u00adage result\u00ading from improp\u00ader secu\u00adri\u00adty or use of the account.
    IV. Prin\u00adci\u00adples of using the Trans.eu Sys\u00adtem\u2019s API<\/li>\n
  23. Both the Part\u00adner and the Users may not hin\u00adder oper\u00ada\u00adtion of the Trans.eu Sys\u00adtem\u2019s API or attempt to gain access there\u00adto oth\u00ader\u00adwise than using the inter\u00adface and instruc\u00adtions made avail\u00adable by Trans.eu Group S.A. .<\/li>\n
  24. The Trans.eu Sys\u00adtem\u2019s API, via the Website\/Software, allows the Users, among oth\u00aders, to add offers of avail\u00adable loads and vehi\u00adcles to table of exchange offers of the Trans.eu Sys\u00adtem.<\/li>\n
  25. The User shall log in using the Trans.eu Sys\u00adtem\u2019s login win\u00addow on the basis of the indi\u00advid\u00adual User\u2019s login and pass\u00adword, enabling use of the account reg\u00adis\u00adtered by the User in the Trans.eu Sys\u00adtem.<\/li>\n
  26. The Part\u00adner may use the Trans.eu Sys\u00adtem\u2019s API only in a man\u00adner per\u00admit\u00adted by the com\u00admon\u00adly bind\u00ading legal reg\u00adu\u00adla\u00adtions, these Reg\u00adu\u00adla\u00adtions and the Trans.eu Reg\u00adu\u00adla\u00adtions.<\/li>\n
  27. Trans.eu Group S.A. is enti\u00adtled to restrict or revoke the right to log in to the Trans.eu Sys\u00adtem by a User, who has breached the pro\u00advi\u00adsions of the present Reg\u00adu\u00adla\u00adtions.<\/li>\n
  28. Access to the Trans.eu Sys\u00adtem\u2019s API and its use via Trans.eu Group S.A. ser\u00advices does not grant the Part\u00adner nor the User any intel\u00adlec\u00adtu\u00adal prop\u00ader\u00adty rights to the Trans.eu Sys\u00adtem, in par\u00adtic\u00adu\u00adlar, to its ser\u00advices and name.<\/li>\n
  29. The Part\u00adner may not remove, cov\u00ader or change any infor\u00adma\u00adtion dis\u00adplayed in the login win\u00addow of the Trans.eu Sys\u00adtem.<\/li>\n
  30. The Part\u00adner is oblig\u00aded to secure data relat\u00aded to log\u00adging in by the User to the Trans.eu Sys\u00adtem\u2019s API, in par\u00adtic\u00adu\u00adlar: IP address, lis\u00adten port num\u00adber, user name and pass\u00adword, name of the mod\u00adule stor\u00ading the data that are to be made avail\u00adable in the vir\u00adtu\u00adal data\u00adbase.<\/li>\n
  31. The Trans.eu Sys\u00adtem\u2019s API enables the User to load, send, deliv\u00ader, save, store, send and receive con\u00adtent in com\u00admu\u00adni\u00adca\u00adtion with the Website\/Software of the Part\u00adner.<\/li>\n
  32. The Part\u00adner is oblig\u00aded to update the Trans.eu Sys\u00adtem\u2019s API imme\u00addi\u00adate\u00adly after Trans.eu Group S.A. makes its new ver\u00adsion or func\u00adtion avail\u00adable.<\/li>\n
  33. Trans.eu Group S.A. grants the User, who has active access to Trans.eu Group S.A. ser\u00advices, a free, non-trans\u00adfer\u00adable and non-exclu\u00adsive license for using the Trans.eu Sys\u00adtem through the Trans.eu Sys\u00adtem\u2019s API made avail\u00adable by Trans.eu Group S.A. on the Website\/in the Soft\u00adware of the Part\u00adner. This licence is intend\u00aded only to allow the User to use the ser\u00advices pro\u00advid\u00aded by Trans.eu Group S.A. in a man\u00adner per\u00admit\u00adted by the Reg\u00adu\u00adla\u00adtions of Trans.eu, not lim\u00adit\u00aded by the Trans.eu Sys\u00adtem\u2019s API func\u00adtion\u00adal\u00adi\u00adties.<\/li>\n
  34. Rela\u00adtions between the Trans.eu Sys\u00adtem\u2019s login win\u00addow, cre\u00adat\u00aded on the basis of the Trans.eu Sys\u00adtem\u2019s API, and the Website\/Software of the Part\u00adner are inde\u00adpen\u00addent from one anoth\u00ader.<\/li>\n
  35. Dur\u00ading log\u00adging in to the Trans.eu Sys\u00adtem via the login win\u00addow cre\u00adat\u00aded on the basis of the Trans.eu Sys\u00adtem\u2019s API, the User decides to per\u00admit or refuse trans\u00adfer of infor\u00adma\u00adtion con\u00adcern\u00ading the data of the Ini\u00adtial Account and the Deriv\u00ada\u00adtive Account, defined in the Reg\u00adu\u00adla\u00adtions of Trans.eu, in par\u00adtic\u00adu\u00adlar:
    a) full name of the user,
    b) e\u2011mail address,
    c) Tran\u00adsId iden\u00adti\u00adfi\u00adca\u00adtion num\u00adber
    d) con\u00adtact tele\u00adphone num\u00adber.<\/li>\n
  36. After the User\u2019s per\u00admis\u00adsion to trans\u00adfer infor\u00adma\u00adtion, the Part\u00adner is oblig\u00aded to each time ver\u00adi\u00adfy the User before grant\u00adi\u00adng him access to API resources of the Trans.eu Sys\u00adtem.<\/li>\n
  37. The Part\u00adner is oblig\u00aded to use Users access accord\u00ading to their due pur\u00adpose.<\/li>\n
  38. Refusal to trans\u00adfer data, referred to in item IV.13 of these Reg\u00adu\u00adla\u00adtions, restricts the User\u2019s use of the Trans.eu Sys\u00adtem via the Website\/Software to the extent allowed by the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  39. Trans.eu Group S.A. reserves the right to tem\u00adporar\u00adi\u00adly \u2014 par\u00adtial\u00adly or total\u00adly \u2014 shut down the Trans.eu Sys\u00adtem\u2019s API or restrict access there\u00adto, in order to improve it, add func\u00adtion\u00adal\u00adi\u00adties, con\u00adduct main\u00adte\u00adnance or repairs, with\u00adout pri\u00ador noti\u00adfy\u00ading the Part\u00adner of this fact.
    V. Licence<\/li>\n
  40. Trans.eu Group S.A. here\u00adby declares that it is enti\u00adtled to exclu\u00adsive copy\u00adright to the Trans.eu Sys\u00adtem and to the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  41. The Part\u00adner here\u00adby states that he is enti\u00adtled to an exclu\u00adsive licence on all fields of exploita\u00adtion nec\u00ades\u00adsary for using, devel\u00adop\u00ading and dis\u00adtrib\u00adut\u00ading the Website\/Software, the func\u00adtion\u00adal\u00adi\u00adties of which are described under the fol\u00adlow\u00ading address\u00ades: http:\/\/transeu.github.io\/api-rest-documentation\/.<\/li>\n
  42. Trans.eu Group S.A. grants to the Part\u00adner a free, non-exclu\u00adsive, non-trans\u00adfer\u00adable and unlim\u00adit\u00aded in terms of area \u2014 but lim\u00adit\u00aded in terms of time \u2014 license for the Trans.eu Sys\u00adtem\u2019s API on the fol\u00adlow\u00ading fields of exploita\u00adtion:
    a) use of the Trans.eu Sys\u00adtem\u2019s API in the process of inte\u00adgra\u00adtion with the Trans.eu Sys\u00adtem, in par\u00adtic\u00adu\u00adlar, adap\u00adta\u00adtion of the Trans.eu Sys\u00adtem\u2019s API,
    b) use of the Trans.eu Sys\u00adtem\u2019s API for dis\u00adplay\u00ading login win\u00addows on the Website\/in the Soft\u00adware dis\u00adtrib\u00aduted by the Part\u00adner, in order to allow the Users to use the Trans.eu Sys\u00adtem.<\/li>\n
  43. The licence, referred to in item V.3. above, is grant\u00aded for the peri\u00adod of use of the Trans.eu Sys\u00adtem\u2019s API by the Part\u00adner.<\/li>\n
  44. The licence shall expire as of Trans.eu Group S.A. revok\u00ading the Part\u00adner\u2019s access to the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  45. Trans.eu Group S.A. express\u00ades its con\u00adsent to use its logo and image in pro\u00admo\u00adtion\u00adal and adver\u00adtis\u00ading mate\u00adri\u00adals of the Part\u00adner, and grants a licence to the Part\u00adner for using the \u201cTrans.eu\u201d trade\u00admark. The prin\u00adci\u00adples of using the logo and image, as well as the prin\u00adci\u00adples of grant\u00adi\u00adng the licence for using the trade\u00admark, shall be sub\u00adject to sep\u00ada\u00adrate agree\u00adments.
    VI. Oblig\u00ada\u00adtions of the Part\u00adner<\/li>\n
  46. The Part\u00adner is oblig\u00aded to pro\u00advide any infor\u00adma\u00adtion, sup\u00adply any data and doc\u00adu\u00adments nec\u00ades\u00adsary for cor\u00adrect inte\u00adgra\u00adtion of the Trans.eu Sys\u00adtem\u2019s API with the Website\/Software.<\/li>\n
  47. The Part\u00adner is oblig\u00aded to pro\u00advide the User with any infor\u00adma\u00adtion relat\u00aded to the autho\u00adri\u00adsa\u00adtion of the Trans.eu Sys\u00adtem\u2019s API to access infor\u00adma\u00adtion.<\/li>\n
  48. The Part\u00adner under\u00adtakes to ensure com\u00adpat\u00adi\u00adbil\u00adi\u00adty of the Website\/Software with the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  49. The Part\u00adner is oblig\u00aded to adjust the Website\/Software to the Trans.eu Sys\u00adtem\u2019s API in the event of updat\u00ading the Trans.eu Sys\u00adtem\u2019s API, with\u00adin 21 days from Trans.eu Group S.A. inform\u00ading the Part\u00adner of the update.<\/li>\n
  50. The Part\u00adner express\u00ades his per\u00admis\u00adsion for his logo and image to be used in pro\u00admo\u00adtion\u00adal and adver\u00adtis\u00ading mate\u00adri\u00adals of Trans.eu Group S.A. , and grants Trans.eu Group S.A. a licence for using the trade\u00admark belong\u00ading to the Part\u00adner. The prin\u00adci\u00adples of using the logo and image, as well as the prin\u00adci\u00adples of grant\u00adi\u00adng the licence for using the trade\u00admark, shall be sub\u00adject to sep\u00ada\u00adrate agree\u00adments.
    VII. Respon\u00adsi\u00adbil\u00adi\u00adty of Trans.eu Group S.A.<\/li>\n
  51. Either Par\u00adty is respon\u00adsi\u00adble for any dam\u00adages aris\u00ading as a result of default or improp\u00ader per\u00adfor\u00admance of the pro\u00advi\u00adsions result\u00ading from the present Reg\u00adu\u00adla\u00adtions on gen\u00ader\u00adal terms under, exclud\u00ading lost ben\u00ade\u00adfits, sub\u00adject to item VIII.2 and IX.2 of these Reg\u00adu\u00adla\u00adtions.<\/li>\n
  52. Trans.eu Group S.A. is not respon\u00adsi\u00adble for activ\u00adi\u00adties relat\u00aded to test\u00ading cor\u00adrect\u00adness of the records in the data\u00adbas\u00ades processed by the Trans.eu Sys\u00adtem\u2019s API, their cor\u00adrec\u00adtion or main\u00adte\u00adnance.<\/li>\n
  53. Trans.eu Group S.A. shall not bear guar\u00adan\u00adtee or com\u00adpen\u00adsa\u00adtion lia\u00adbil\u00adi\u00adty for any effects of use of the Trans.eu Sys\u00adtem\u2019s API under con\u00addi\u00adtions of incor\u00adrect oper\u00ada\u00adtion of the com\u00adput\u00ader sys\u00adtem, caused by hard\u00adware defects or improp\u00ader instal\u00adla\u00adtion of the sys\u00adtem or com\u00adput\u00ader virus\u00ades, and in cas\u00ades of incor\u00adrect oper\u00ada\u00adtion of the Trans.eu Sys\u00adtem\u2019s API, incor\u00adrect inter\u00adpre\u00adta\u00adtion of results, being unfa\u00admil\u00adiar with the legal reg\u00adu\u00adla\u00adtions, or inter\u00adfer\u00adence of unau\u00adtho\u00adrised per\u00adsons in the Trans.eu Sys\u00adtem\u2019s API or data\u00adbas\u00ades.
    VIII. Respon\u00adsi\u00adbil\u00adi\u00adty of the Part\u00adner<\/li>\n
  54. The Part\u00adner is oblig\u00aded to use the Trans.eu Sys\u00adtem\u2019s API made avail\u00adable there\u00adto in accor\u00addance with its intend\u00aded use, as well as to use the Trans.eu Sys\u00adtem\u2019s data\u00adbase in a man\u00adner con\u00adsis\u00adtent with the Reg\u00adu\u00adla\u00adtions of Trans.eu. In par\u00adtic\u00adu\u00adlar, the Part\u00adner may not:
    a) use the access to the Trans.eu Sys\u00adtem in order to down\u00adload the con\u00adtent of the whole or part of the soft\u00adware, defined in the Reg\u00adu\u00adla\u00adtions of Trans.eu and the Trans.eu Sys\u00adtem, in par\u00adtic\u00adu\u00adlar, User Data\u00adbas\u00ades defined in the Reg\u00adu\u00adla\u00adtions of Trans.eu, as well as reuse them, either in full or in part, with\u00adout an explic\u00adit writ\u00adten con\u00adsent of Trans.eu Group S.A. \u201a
    b) send com\u00admer\u00adcial infor\u00adma\u00adtion, as defined by Arti\u00adcle 10 of the Act of 18 July 2002 on Pro\u00advi\u00adsion of Ser\u00advices by Elec\u00adtron\u00adic Means (Jour\u00adnal of Laws Dz. U. of 2004, No. 96, item 959) to oth\u00ader users of the Trans.eu Sys\u00adtem,
    c) share the Trans.eu Sys\u00adtem data\u00adbase, either in full or in part, with third par\u00adties or enable third par\u00adties to access the Trans.eu Sys\u00adtem in any way; this pro\u00advi\u00adsion does not apply to mak\u00ading the data\u00adbase avail\u00adable to the Users and their access to the Trans.eu Sys\u00adtem via the Website\/Software, in accor\u00addance with the spec\u00adi\u00adfi\u00adca\u00adtion of the Trans.eu Sys\u00adtem\u2019s API.<\/li>\n
  55. In the event of breach of any of the oblig\u00ada\u00adtions, spec\u00adi\u00adfied in let\u00adter a. \u2014 c. above, the Part\u00adner shall pay to Trans.eu Group S.A. a con\u00adtrac\u00adtu\u00adal penal\u00adty fee in the amount of PLN 100,000.00 (in words: one hun\u00addred thou\u00adsand Pol\u00adish zlo\u00adtys). The oblig\u00ada\u00adtion to pay the con\u00adtrac\u00adtu\u00adal penal\u00adty fee does not exclude the right of Trans.eu Group S.A. to exer\u00adcise oth\u00ader rights grant\u00aded there\u00adto under the pro\u00advi\u00adsions result\u00ading from the present Reg\u00adu\u00adla\u00adtions or the pro\u00advi\u00adsions of com\u00admon\u00adly bind\u00ading laws. Trans.eu Group S.A. shall be, in par\u00adtic\u00adu\u00adlar, autho\u00adrised to claim dam\u00adages from the Part\u00adner on gen\u00ader\u00adal terms, in the amount high\u00ader than the amount of the stip\u00adu\u00adlat\u00aded con\u00adtrac\u00adtu\u00adal penal\u00adty fee.
    IX. Con\u00adfi\u00adden\u00adtial\u00adi\u00adty<\/li>\n
  56. Both Trans.eu Group S.A. and the Part\u00adner are oblig\u00aded to keep con\u00adfi\u00adden\u00adtial any infor\u00adma\u00adtion, both dur\u00ading the peri\u00adod of mak\u00ading avail\u00adable the Trans.eu Sys\u00adtem\u2019s API to the Part\u00adner and after this time, in par\u00adtic\u00adu\u00adlar tech\u00adni\u00adcal, tech\u00adno\u00adlog\u00adi\u00adcal, com\u00admer\u00adcial, organ\u00adi\u00adsa\u00adtion\u00adal, finan\u00adcial or legal infor\u00adma\u00adtion con\u00adcern\u00ading the oth\u00ader Par\u00adty.<\/li>\n
  57. In the event of Trans.eu Group S.A. or the Part\u00adner, or a third par\u00adty used by a giv\u00aden Par\u00adty to per\u00adform the oblig\u00ada\u00adtions result\u00ading from the pro\u00advi\u00adsions of these Reg\u00adu\u00adla\u00adtions, breach\u00ading the con\u00adfi\u00adden\u00adtial\u00adi\u00adty oblig\u00ada\u00adtion, the Par\u00adty in breach shall be oblig\u00aded to pay to the oth\u00ader par\u00adty a con\u00adtrac\u00adtu\u00adal penal\u00adty fee in the amount of PLN 100,000.00 (in words: one hun\u00addred thou\u00adsand Pol\u00adish zlo\u00adtys). The oblig\u00ada\u00adtion to pay the con\u00adtrac\u00adtu\u00adal penal\u00adty fee does not exclude the right of the aggriev\u00aded Par\u00adty to exer\u00adcise its oth\u00ader rights under the pro\u00advi\u00adsions of these Reg\u00adu\u00adla\u00adtions or the pro\u00advi\u00adsions of com\u00admon\u00adly bind\u00ading laws. The aggriev\u00aded Par\u00adty shall be in par\u00adtic\u00adu\u00adlar enti\u00adtled to claim dam\u00adages from the oth\u00ader Par\u00adty on gen\u00ader\u00adal terms, in the amount high\u00ader than the amount of the stip\u00adu\u00adlat\u00aded con\u00adtrac\u00adtu\u00adal penal\u00adty fee.
    X. Peri\u00adod of mak\u00ading avail\u00adable the Trans.eu Sys\u00adtem\u2019s API<\/li>\n
  58. Trans.eu Group S.A. grants to the Part\u00adner access to the Trans.eu Sys\u00adtem\u2019s API for indef\u00adi\u00adnite time, and Trans.eu Group S.A. may revoke the Part\u00adner\u2019s access to the Trans.eu Sys\u00adtem\u2019s API in cas\u00ades, when the Part\u00adner has breached the pro\u00advi\u00adsions of the present Reg\u00adu\u00adla\u00adtions and the Reg\u00adu\u00adla\u00adtions of Trans.eu.<\/li>\n
  59. In the event of the Part\u00adner breach\u00ading the pro\u00advi\u00adsions of these Reg\u00adu\u00adla\u00adtions, Trans.eu Group S.A. shall call the Part\u00adner to imme\u00addi\u00adate\u00adly cease the breach\u00ades. If the Part\u00adner does not com\u00adply with the call, referred to in the pre\u00advi\u00adous sen\u00adtence, Trans.eu Group S.A. may revoke the Part\u00adner\u2019s access to the Trans.eu Sys\u00adtem\u2019s API with\u00adout any fur\u00adther calls.<\/li>\n
  60. The Part\u00adner, in order to resign from using the Trans.eu Sys\u00adtem\u2019s API, shall noti\u00adfy Trans.eu Group S.A. of this fact via a mes\u00adsage sent to api@trans.eu.
    XI. Final Pro\u00advi\u00adsions<\/li>\n
  61. In any cas\u00ades not reg\u00adu\u00adlat\u00aded in these Reg\u00adu\u00adla\u00adtions, the com\u00admon\u00adly bind\u00ading Pol\u00adish law shall apply.<\/li>\n
  62. Any dis\u00adputes aris\u00ading between the Part\u00adner and Trans.eu Group S.A. in con\u00adnec\u00adtion with exe\u00adcu\u00adtion of the pro\u00advi\u00adsions of these Reg\u00adu\u00adla\u00adtions shall be resolved by the com\u00admon court com\u00adpe\u00adtent for the seat of the Part\u00adner.<\/li>\n<\/ol>\n\n\n\n
