Appendix 6 to the Regulations - TransMap

1. DEFINITIONS

TransMap® (Product)

The data visualisation service, i.e. electronic maps, with related functionalities.

Partners

The providers of software, maps, data and materials which are used in the Product pursuant to the granted licences, i.e. PTV Planung Transport Verkehr AG – the manufacturer of Map & Guide Proffesional and Emapa  Sp. z o.o. The expansion of the number of Partners shall not require the amendments to the Regulations.  

2. PRINCIPLES OF USE

2.1 The use of the TransMap service or any other data or information made available through it shall mean that the User accepts the Regulations concerning the use of the exchange, in particular this Appendix, and undertakes to observe them.
2.2 The TransMap service is made available in the basic version – without any additional charges – and in the Paid Version.
2.3 The materials for maps and other related data (maps) are made available by the Partners – licensors. The software and data provided by the Partners, as well as TransMap itself, are protected with the copyright and pursuant to the governing legal regulations. Copying (in whole or in part), distribution or other processing are regulated in the licence agreement and these Regulations. The violation of any provisions shall be subject to civil law and criminal law sanctions.
2.4 The Service Provider shall grant the User the non-transferable and non-exclusive sublicence to use TransMap only for internal purposes.
2.6 Subject to point, the User cannot copy, divide, extract or modify the maps or create derivative products from them. The User cannot change in whole or in part the source code, source files or structure of maps or attempt to change them through reconstruction, division, decompilation or with other methods.
2.6 The User cannot use the products for running the company providing services and for other purposes which involve the processing of maps by other persons or units.
2.7 The User shall not receive the property rights which vest in whole in the licensors. The information about the copyrights, sources or reservations concerning the property right located on or attached to the maps cannot be modified, covered or deleted.
2.8 The User may install on the hard disk and use the obtained results only for own internal purposes or prepare the backup which shall be appropriately marked. Such a copy may be used only and exclusively as a backup. It is in the possession and custody of the User.

3. BASIC/PAID VERSION

3.1 TransMap is made available without any additional charges in the basic version to all Trans Exchange Users.
3.2 The basic version includes the following elements: map miniatures, route description, results of search with additional information which may be saved by the Users.
3.3 The paid version (hereinafter referred to as the Paid Version) includes additional data from external sources (Partners) concerning:
a)    petrol stations
b)    road limitations, impediments on road, road conditions, information about road conditions updated in real time
c)    tolls, ferry charges
d)    data from bases and IT systems of clients (warehouse inventory sheets, etc.)
e)    other useful information.
3.4 The points added by the User are stored also after the expiry of the period for which the subscription fee has been paid. The User does not have the possibility of modifying or deleting the entered data.
3.5 In the Paid version, the User sees the results of search of loads and vehicles on the map (the information about the coordinates of offers comes from Partners).

4. TERMS OF PAYMENT

4.1 The provision of services in the Paid Version is paid in accordance with the payment terms and conditions specified in point 5 of the Regulations of the exchange user.
4.2 The amount of monthly fees is specified in the price list available at: http://www.trans.eu/en/price-list.html
4.3 The Service Provider reserves the right to amend the price list.

5. SERVICE PROVIDER’S LIABILITY

5.1 The Service Provider does not guarantee that the Product is available all the time, free from defects and punctual. Any delays or errors in the scope of availability or data transmission may occur as a result of technical problems.
5.2 The shown maps and information are not the complete reflection of reality and are only the visualisation. The information made available within the TransMap service is used only as a support for planning. The real conditions of access to the searched point may differ from the shown ones as a result of weather conditions, roadworks, traffic jams or other circumstances.
5.3 TransMap cannot be used as the only basis for performing professional activities in the scope of planning/routing.

6. FINAL PROVISIONS

6.2 The Service Provider shall be entitled to unilaterally amend the provisions of these Regulations. The amendments shall become effective upon publishing the amended Regulations at the following address: http://www.trans.eu/en/regulations.html.
